1.Agreement to these terms
These Terms of Service ("Terms") form a binding agreement between you (and the organization you represent, "you") and Runtimez ("Runtimez", "we", "us"). By accessing our website, installing the agent, or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2.The Service
Runtimez provides read-only Kubernetes deployment intelligence: it connects to a live cluster via a single Helm install and surfaces upgrade blockers, image CVEs, production-readiness gaps, cost waste, and risky workload changes, scored and correlated across upgrade and security risk. The Service runs on managed Kubernetes including EKS, GKE, and AKS. Features are under active development and may change.
3.Eligibility & authority to install
You must be at least 18 and able to form a binding contract. Critically, you represent and warrant that you are authorized to install software into, and grant read access to, any Kubernetes cluster on which you deploy the agent, and that doing so does not violate any policy, contract, or law that applies to you or that cluster's owner. You are responsible for obtaining any internal approvals required before connecting a cluster.
4.The read-only agent & your responsibilities
The agent requests read-only (get/list/watch) permissions and is designed not to modify cluster state. You are responsible for reviewing the Helm chart and RBAC it requests, for the security of your own cluster and credentials, and for how your team acts on the findings we surface. Runtimez provides analysis and recommendations; decisions about changes to your infrastructure remain yours.
5.Accounts
You are responsible for maintaining the confidentiality of any account credentials and connection tokens, and for all activity under your account. Notify us promptly at hello@runtimez.io if you suspect unauthorized use.
6.Acceptable use
You agree not to: (a) use the Service on clusters you're not authorized to access; (b) reverse engineer, resell, or provide the Service to third parties except as permitted; (c) interfere with or disrupt the Service; (d) probe or circumvent our security; or (e) use the Service to violate any law or third-party right.
7.Fees & billing
Your first cluster is free. Paid tiers are usage-based and in early access — pay-as-you-go meters cover items such as extra deployment checks, active services, connected clusters, observability ingestion, and advanced AI analysis. Final pricing is set at launch, and we'll give you notice before charging you. Fees are exclusive of taxes, which you're responsible for. Except where required by law, fees are non-refundable.
8.Intellectual property
The Service, including the agent, website, and all related software and content, is owned by Runtimez and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. You retain all rights to your cluster data; you grant us the rights necessary to operate the Service and generate your findings.
9.Confidentiality
Each party may access the other's confidential information. We treat your cluster metadata and findings as confidential and use them only to provide and improve the Service, consistent with our Privacy Policy.
10.Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Runtimez surfaces risk signals to help you make decisions; we do not warrant that it identifies every risk, CVE, or upgrade blocker, or that acting on findings will prevent any incident. During early access the Service may be interrupted or changed.
11.Limitation of liability
To the maximum extent permitted by law, Runtimez will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or US $100.
12.Indemnification
You agree to indemnify and hold Runtimez harmless from claims, damages, and expenses arising from your use of the Service, your violation of these Terms, or your installation of the agent on a cluster you were not authorized to access.
13.Term & termination
These Terms apply while you use the Service. You may stop at any time by uninstalling the agent (removing the Helm release), which ends its read access to your cluster immediately, and by asking us to close your account. We may suspend or terminate access if you breach these Terms or to protect the Service. Sections that by their nature should survive termination will survive.
14.Changes to the Service & these Terms
We may update the Service and these Terms. When changes are material, we'll update the date above and, where appropriate, notify you. Continued use after an update means you accept the revised Terms.
15.Governing law
These Terms are governed by the laws applicable to the entity operating Runtimez, without regard to conflict-of-law principles, and you agree to the exclusive jurisdiction of the courts in that location for any dispute, except that either party may seek injunctive relief where appropriate.
